1. Warranty Period

The warranty period begins on the date Cheetah Coatings substantially completes the covered installation and continues for ten (10) years, provided the installation qualifies for coverage and the customer complies with the requirements of this warranty.

2. What This Warranty Covers

This warranty applies to defects that are determined to have resulted directly from Cheetah Coatings’ installation workmanship.

Subject to inspection and the other terms of this warranty, covered workmanship defects may include:

• peeling or delamination caused by improper installation;
• loss of adhesion attributable to Cheetah Coatings’ surface preparation or application;
• other installation-related failures determined by Cheetah Coatings to result from defective workmanship.

Coverage applies only to the specific surfaces and coating systems identified as covered in the customer’s written proposal, contract, invoice, or warranty documentation.

3. What This Warranty Does Not Cover

This warranty does not cover damage, deterioration, discoloration, failure, or other conditions caused by circumstances unrelated to Cheetah Coatings’ workmanship, including, where applicable:

• cracks, movement, settling, shifting, expansion, contraction, or deterioration of the underlying concrete, wood, substrate, structure, or building;
• pre-existing cracks or defects, including cracks that reappear after repair;
• hydrostatic pressure, groundwater, moisture vapor transmission, excessive substrate moisture, flooding, plumbing leaks, drainage problems, or other moisture-related conditions;
• structural movement or failure;
• impact, abrasion, gouging, scratching, misuse, abuse, negligence, accidents, or improper maintenance;
• damage caused by vehicles, equipment, machinery, furniture, tools, sharp objects, hot tires, chemicals, solvents, petroleum products, deicing materials, or other substances beyond the coating system’s specifications;
• exposure to conditions or chemicals for which the installed system was not designed;
• fire, flood, storm, natural disaster, casualty, vandalism, or other events outside Cheetah Coatings’ reasonable control;
• work, repairs, modifications, cleaning treatments, or coatings performed by anyone other than Cheetah Coatings after installation;
• ordinary wear and tear;
• normal variations in color, texture, gloss, aggregate distribution, decorative pattern, or appearance inherent in hand-applied coating systems;
• fading, yellowing, or color changes resulting from sunlight or UV exposure unless the applicable coating system is expressly warranted against such conditions;
• conditions resulting from failure to follow Cheetah Coatings’ written care, maintenance, cure-time, or use instructions; or
• defects attributable solely to a product or material manufacturer rather than Cheetah Coatings’ installation workmanship.

4. Existing Concrete and Substrate Conditions

Concrete and other substrates naturally move and may develop cracks over time. Repairing or coating an existing crack does not guarantee that the crack will never reappear.

Cheetah Coatings is not responsible under this workmanship warranty for future substrate movement, structural cracking, settling, moisture intrusion, or other underlying conditions that are outside Cheetah Coatings’ control.

5. Manufacturer Warranties

Certain products or coating systems may carry warranties provided by their manufacturers.

Any manufacturer warranty is separate from this Cheetah Coatings workmanship warranty and is governed by the manufacturer’s own terms, exclusions, procedures, and remedies.

Cheetah Coatings does not expand or replace a manufacturer’s warranty unless expressly agreed to in writing.

6. Customer Responsibilities

To maintain eligibility for warranty coverage, the customer must:

• follow all written curing, care, cleaning, and maintenance instructions provided by Cheetah Coatings;
• use the coated surface only for reasonably intended purposes;
• take reasonable steps to prevent damage;
• promptly address leaks, drainage problems, moisture intrusion, or structural problems; and
• notify Cheetah Coatings promptly after discovering a suspected workmanship defect.

7. Warranty Claims

To submit a warranty claim, please contact Cheetah Coatings using the information below.

When submitting a warranty claim, please provide your name, installation address, approximate project completion date, a description of the concern, photographs, and any additional information neceesary to evaluate the claim.

Cheetah Coatings must be given an opportunity to inspect the affected area before repairs or alterations are performed by another party, except where immediate action is necessary to prevent additional property damage.

8. Inspection and Determination

A warranty claim is not automatically covered merely because a coating has experienced a problem during the warranty period.

Cheetah Coatings may inspect the affected area and reasonably determine whether the condition resulted from covered installation workmanship or from an excluded condition.

9. Warranty Remedy

For a valid covered claim, Cheetah Coatings will, at its option and subject to applicable law, repair or reperform the affected portion of the covered work necessary to address the workmanship defect.

Any remedy will be limited to the affected covered area and does not automatically require replacement of unaffected portions of the installation.

10. Appearance of Warranty Repairs

Because coatings, colors, aggregates, textures, materials, and surrounding surfaces may change with age and exposure, an exact color, sheen, texture, pattern, or aggregate match during a warranty repair cannot always be guaranteed.

Reasonable appearance differences between repaired and existing areas do not, by themselves, constitute defective workmanship.

11. Transferability

Unless Cheetah Coatings expressly agrees otherwise in writing, this warranty is provided to the original contracting customer and is not transferable to subsequent property owners.

12. Commercial Projects

For commercial installations, any project-specific warranty requirements contained in a signed written agreement will control if they expressly differ from this warranty.

13. No Unauthorized Modification

No employee, salesperson, subcontractor, installer, or other representative may modify or expand this warranty unless the modification is made in writing and authorized by Cheetah Coatings.

14. Applicable Law

This warranty is governed by applicable law. Nothing in this warranty is intended to waive or restrict any right or remedy that cannot legally be waived or restricted.
