1. Estimates and Proposals

Quotes and estimates are based on information reasonably available when prepared, including customer-provided information and observable site conditions.

Pricing or scope may require adjustment if concealed, unexpected, or materially different site conditions are discovered after work begins.

Unless otherwise stated in writing, estimates are not guarantees regarding conditions that could not reasonably be observed before work begins.

2. Scope of Work

Cheetah Coatings will perform the services described in the customer’s accepted proposal or written agreement.

Work not expressly included in the agreed scope is considered additional work and may require additional charges and customer authorization.

3. Customer Authorization

The customer represents that they own the property or are legally authorized to approve the requested work.

The customer is responsible for obtaining any approval required from a property owner, landlord, condominium association, homeowners association, property manager, or other third party unless Cheetah Coatings expressly agrees otherwise in writing.

4. Site Access

The customer must provide reasonable access to the work area during scheduled installation times.

The work area should be cleared of vehicles, personal belongings, furniture, equipment, and other obstructions unless different arrangements have been made in writing.

Delays or additional work caused by inaccessible or unprepared areas may result in rescheduling or additional charges where permitted by the parties’ agreement and applicable law.

5. Existing and Hidden Conditions

Coating performance can be affected by conditions that may not be visible before work begins, including moisture, contamination, previous coatings, concrete deterioration, structural movement, hidden repairs, and substrate defects.

If unexpected conditions are discovered, Cheetah Coatings may pause work and discuss recommended changes, additional preparation, pricing, or scheduling with the customer before proceeding with material additional work.

6. Surface Preparation

Proper surface preparation is an essential part of coating installation.

Cheetah Coatings may use grinding, cleaning, profiling, crack treatment, patching, or other preparation appropriate to the agreed coating system and existing conditions.

Surface preparation cannot eliminate future structural movement or guarantee that existing or future cracks will never appear.

7. Decorative and Natural Variations

Samples, photographs, displays, digital images, and website photographs are intended to demonstrate general appearance.

Actual installed coatings may vary in color, texture, gloss, aggregate distribution, decorative pattern, and appearance due to materials, lighting, substrate conditions, application techniques, and normal manufacturing variation.

8. Scheduling and Weather

Installation dates and completion estimates may be affected by weather, temperature, humidity, substrate moisture, material availability, site conditions, curing requirements, or other circumstances reasonably outside Cheetah Coatings’ control.

Cheetah Coatings may reasonably reschedule work when conditions are unsuitable for proper installation.

9. Cure Times and Return to Service

Customers must follow the cure-time and return-to-service instructions provided for their specific coating system.

Cure times may vary based on the system installed and environmental conditions. Customers should not assume that every coating can safely accept foot traffic, vehicles, furniture, equipment, chemicals, or other loads after the same amount of time.

Cheetah Coatings is not responsible for damage resulting from premature use contrary to provided instructions.

10. Changes to the Work

Any requested change to the agreed scope may affect pricing, materials, scheduling, and completion time.

Material changes should be documented through a written change order or other written authorization before the additional work is performed.

11. Payment

Payment amounts, deposits, progress payments, final balances, and due dates will be specified in the applicable proposal, contract, invoice, or other written project agreement.

The customer agrees to make payments according to those agreed terms.

Any late-payment charge, collection cost, financing term, deposit rule, or cancellation charge will apply only to the extent stated in the applicable agreement and permitted by law.

12. Cancellation and Rescheduling

Cancellation and rescheduling rights and obligations are governed by the customer’s project agreement and applicable law.

Nothing in these Terms limits any statutory cancellation or rescission right available to a customer.

13. Property and Personal Items

Customers are responsible for removing or protecting valuables and personal property from the work area unless otherwise agreed.

Cheetah Coatings will use reasonable care while performing services but is not responsible for pre-existing damage or conditions unrelated to its work.

14. Photographs

Cheetah Coatings may request permission to photograph completed projects for documentation, portfolio, website, advertising, or social-media purposes.

Where customer permission is required, photographs will be used in accordance with the authorization provided.

15. Warranty

Qualifying installations may be covered by the separate Cheetah Coatings 10-Year Limited Workmanship Warranty.

Warranty eligibility, coverage, exclusions, claims, and remedies are governed by that warranty document and any applicable project-specific written agreement.

16. Manufacturer Materials

Products used on a project may be subject to manufacturer specifications and warranties.

Manufacturer warranties are issued by the manufacturer and remain subject to the manufacturer’s requirements, exclusions, and remedies.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Cheetah Coatings will not be responsible for indirect, incidental, special, exemplary, or consequential damages arising from matters outside the scope of remedies required by applicable law or expressly agreed in writing.

Any limitation contained in these Terms applies only to the extent enforceable under applicable law and does not exclude liability that legally cannot be excluded or limited.

18. Force Majeure and Events Outside Reasonable Control

Cheetah Coatings is not responsible for reasonable delays caused by events outside its control, including severe weather, natural disasters, utility interruptions, supply disruptions, governmental restrictions, emergencies, labor disruptions, or similar circumstances.

Cheetah Coatings will make reasonable efforts to communicate significant scheduling changes.

19. Customer Communications

Customers are responsible for providing accurate contact information and promptly communicating relevant changes regarding scheduling, property access, project conditions, or other matters affecting the work.

20. Electronic Communications and Signatures

Where permitted by law, proposals, approvals, change orders, notices, invoices, signatures, and other project communications may be provided electronically.

Electronic acceptance or signature may have the same effect as a physical signature where permitted by applicable law.

21. Website Content

Information on the Cheetah Coatings website is provided for general informational purposes and does not replace the terms of a customer’s specific written project agreement.

Photos labeled as examples or inspiration are not representations of actual Cheetah Coatings projects unless expressly identified otherwise.

22. Intellectual Property

The Cheetah Coatings name, logo, branding, original website content, graphics, and other proprietary materials may not be copied, reproduced, distributed, or commercially used without authorization, except as permitted by law.

23. Privacy

Information submitted through quote requests, contact forms, email, telephone, or other channels will be handled according to the Cheetah Coatings Privacy Policy and applicable law.

A separate Privacy Policy is accessible from the website footer.

24. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

25. Entire Agreement

These general Terms, together with the applicable signed proposal, contract, change orders, warranty documents, and other incorporated written terms, constitute the applicable agreement concerning the services provided.

26. Governing Law

These Terms will be governed by the laws applicable to the transaction and project location, subject to any consumer rights or other legal protections that cannot be waived.
